Inter-American constitutionalism: The interaction between human rights and progressive constitutional law in Latin America

Abstract

In the present chapter I will explore the links between two normative systems that overlap, complement each other, and sometimes come into tension. I refer to international human rights law, particularly the part emanating from the Inter-American organs of protection, and the domestic constitutional law of Latin American States. The analysis I propose seeks to determine the spaces for work and intervention that allow the deployment of a robust agenda of protection of fundamental rights and public liberties, through observing new dynamics of the creation of this law and the processes of internalization by States and supra-regional bodies.
