Abstract
This oral presentation of a written paper explores briefly why some Western legal systems have traditionally been hostile to gift giving. The transactional private law is generally concerned with the market and therefore fails to understand transfers that are not part of an exchange. To grasp gift giving, the law has had to distort many of its concepts. I conclude that some legal prohibitions indirectly confirm the continued existence of the obligations to give, to receive, and to reciprocate.
